Licensure Investigations/Board Actions
All licensed professionals in New York State are subject to investigations and potential discipline by the a State licensing agency. For physicians and physician’s assistants that agency is the New York State Department of Health Office of Professional Misconduct, also known as OPMC. For all other professions, the regulating agency is the New York State Education Department Office of Professional Discipline. These offices have unique procedures and ultimately the power to discipline professionals, including suspension and even revocation of a license. If you ever receive an inquiry from one of these offices, it is critical that you have assistance from an attorney qualified and experience in handling such matters. Many professional malpractice insurance policies include coverage for legal fees and costs incurred to defend the professionals during such investigations and proceedings.
